Terms of Service

These Terms of Service ("Terms") govern your use of the website at www.polarisdgtl.com and any services provided by Polaris Digital Studio ("we," "us," or "our"). By accessing our site or purchasing our services, you agree to these Terms.

1. Services

Polaris Digital Studio provides two types of services:

• One-time web design packages (Anchor, Launch, Accelerate, Apex, Campaign) — a single payment for a defined scope of work.
• LeadGen subscription ($497/month) — an ongoing monthly service that continues until cancelled according to the terms below.

The specific scope, deliverables, and timeline for each project are agreed upon prior to or at the time of purchase.

2. Payment

• All payments are processed securely through Stripe.
• One-time packages require full payment at the time of purchase.
• The LeadGen subscription is billed monthly on the same date as the original purchase. Your card on file will be charged automatically each billing cycle.
• Prices are listed in USD and are subject to change. Changes to subscription pricing will be communicated with at least 30 days notice.
• The Campaign Special pricing ($500) is a limited-time offer and expires on June 30, 2026.

3. Cancellation — LeadGen Subscription

• Cancellation requests must be submitted via email to team@polarisdgtl.com.
• We will confirm your cancellation within 2 business days. If you do not receive a confirmation, your cancellation has not been processed.
• No refunds are issued for the current billing period once a charge has been processed.
• Access to LeadGen services continues through the end of the paid period.

4. Project Process

• After purchase, you will receive an intake form to provide project details, branding, and content.
• We will deliver initial mockup designs based on your intake responses.
• You are entitled to revision rounds as specified in your package.
• Final delivery requires your written approval of the completed design.
• Project timelines begin upon receipt of your completed intake form and required content.

5. Client Responsibilities

• You are responsible for providing accurate, complete project information in a timely manner.
• You confirm you own or have rights to any content, logos, images, or materials you provide.
• Delays caused by late client responses may extend project timelines without penalty to us.

6. Intellectual Property

Upon full payment, you own the final delivered website design. We retain the right to display the completed work in our portfolio unless you request otherwise in writing. Any third-party assets (fonts, stock images, plugins) remain subject to their respective licenses.

8. Your Data & Right to Deletion

We collect information you provide during the purchase and project process (name, email, business details, project files). This data is used solely to deliver and manage your services.

• Data retention: We retain your project data for up to 12 months after your last active service date.
• Right to deletion: You may request deletion of all personal data we hold about you at any time by emailing team@polarisdgtl.com with the subject line "Delete My Data." We will process your request within 30 days and confirm when deletion is complete.
• Data access: You may request a copy of all data we hold about you by contacting us at the same email address.
• Deletion requests do not affect billing history, which we are required to retain for legal and tax compliance purposes.

9. Limitation of Liability

Polaris Digital Studio is not liable for any indirect, incidental, or consequential damages arising from use of our services. Our total liability is limited to the amount paid for the specific service in question.

10. Website Performance

We build websites to industry best practices for performance and SEO. However, we do not guarantee specific search engine rankings, traffic levels, or business results. Results depend on many factors outside our control.

11. Termination by Either Party

Either party may terminate a project engagement by sending written notice to team@polarisdgtl.com. "Written notice" means an email sent from your registered email address to ours.

• For one-time projects: termination takes effect upon receipt of written notice.
• For the LeadGen subscription: see Section 3 (Cancellation) above.
• In the event of termination, you are entitled to a refund for work not yet started, minus work already delivered. See our Refund Policy for specifics.
• We reserve the right to terminate service immediately if you violate these Terms or engage in abusive conduct toward our team.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall first be attempted to resolve through good-faith negotiation via email. If unresolved after 30 days, disputes may be escalated to binding arbitration or small claims court, at our election.

13. Agreement to These Terms

By completing a purchase on our site, you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, do not complete a purchase.

14. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify existing subscribers of material changes via email at least 14 days before they take effect. Continued use of our services after that date constitutes acceptance of the revised Terms.
